Adult/Waiver Release 

IN CONSIDERATION OF being allowed to participate in any way in the American Public Works Association (APWA) Oregon Chapter Conference, the undersigned acknowledges, appreciates and agrees that:

• There is risk of injury from the activities involved in this event, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of injury does exist; and
• THE UNDERSIGNED ON BEHALF OF ITSELF AND ITS EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, SUCCESSORS AND ASSIGNS (“Releasors”), KNOWINGLY AND FREELY ASSUME SUCH RISKS, both known and unknown, EXCEPT SUCH RISKS ARISING FROM THE GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT OF THE APWA or others. Releasors assume responsibility for participation and any damage or injury arising out of use of equipment owned or leased by APWA;
• Releasors expressly relieve the APWA from any duty of care, which is or may be owed to me as a result of my participation in the event except when risk posed to
  Releasors is due to the gross negligence or intentional misconduct of the APWA; and
• Releasors willingly agree to comply with any stated terms and conditions for participation in the conference; and
• ON ITS OWN BEHALF AND ON BEHALF OF RELEASORS, THE UNDERSIGNED, HEREBY RELEASES AND HOLDS HARMLESS THE AMERICAN PUBLIC WORKS ASSOCIATION (“APWA”), ITS OFFICERS, DIRECTORS, AFFILIATES, CHAPTERS, PARTNERS, SUCCESSORS ASSIGNS, EMPLOYEES AND ANY OTHER PERSONS ACTING ON BEHALF OF THE APWA (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH OR LOSS OR DAMAGE TO PERSONAL PROPERTY, EXCEPT INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE ARISING FROM THE GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT OF THE RELEASEES.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. 

APWA Class Cancellation and Refund Policy:

100% Refund given if cancellation is made before September 17, 2019. No refunds will be made EFFECTIVE October 1, 2019 .

Late Payment Policy:

Total due in 15 days. Overdue accounts are subject to a service charge of 1% per month.
